The biggest recent issues I have come across

15/3/2024

The lockdown in 2020 was just terrible for many different reasons, and I have seen many clients and families who had health issues go unchecked, or who had difficulties getting quick treatment. I have also helped several people who were terminally ill, largely it seems, due to the delay in getting a diagnosis.

A follow on issue is that while having health problems, many people can't think about putting a will in place, or lasting powers of attorney. This is really understandable, as everyone hopes to get through health issues, but worsening health can lead quickly to losing the capacity to set these important documents up.

My advice is therefore to get some advice as quickly as possible, to see what is best to arrange. I can let you know the position you could face without updating your current arrangements. For example, some people have the older style enduring power of attorney. This is mistakenly thought to include health decisions by your attorneys, but it is just for finance matters. People also think having no Will is not a problem - it really can be terrible for your family. So the biggest issue is people delaying help and advice - which can often mean things can't be set up or dealt with in time. Please get advice at least, and then you can make an informed decision over what you need in place. Have a safe 2024.
